Roxana Ruiz was sentenced for the homicide of the man who raped her to a sentence of six years and two months in prison. The judge Monica Palominoof the Judiciary of the State of Mexico, determined that the 23-year-old girl is guilty of “excessive use of self-defense” despite admitting to having been a victim of rape. The magistrate generated outrage by stating that she with “a blow to the head” was enough to defend herself against her.
“I feel sad, disappointed in Justice,” Ruiz said as he left the hearing. “If I hadn’t defended myself, I would be dead,” she told local media.
Likewise, the judge imposed a fine to repair the material damage of 196,267 pesos and a reparation of the moral damage of 89,620 pesos for the family of the offender.
The defense lawyer has challenged the sentence, so the woman will not go to prison until the amparo is resolved. However, Ruiz has already been locked up for nine months awaiting the trial against her.
In an interview with El PaÃs, Ruiz said that he feared for his future and that of his 5-year-old son: “I feel tension in my chest because I don’t want to go back to jail,” he said in August of last year.
The event occurred in 2021. At that time, the woman had been living in the municipality of Nezahualcóyotl for seven years – where she had emigrated from Oaxaca. The citizen was arrested in May of that year for murdering the man who raped her.
Although she had acted in her own defense, Ruiz says that the authorities did not take her testimony into account. “I insisted that I was raped, but they never tested me (…), they did not take pictures, they did not take my statement into account”he wrote in a letter from the Bordo de Xochiaca prison.
Various groups have raised their voices for the court’s lack of a gender perspective. The State of Mexico, where Ruiz lived, was the place with the most femicides in the country last year, which closed with more than 3,500 murdered women.
